29 CFR 1910.120(q)(1)Hazardous waste operations and emergency response: emergency response planAn employer whose employees will respond to emergency releases of hazardous substances must develop and implement a written emergency response plan before those operations begin, and make it available to employees and OSHA. The standard specifies the plan elements, which include pre-emergency planning, personnel roles and lines of authority, evacuation routes and procedures, decontamination, and a critique of the response. An employer that instead evacuates all employees from the danger area and does not permit any employee to assist in handling the emergency is exempt from this paragraph if it provides an emergency action plan under 29 CFR 1910.38.
29 CFR 1910.120(q)(6)Hazardous waste operations and emergency response: training for emergency responseEmployees who participate in an emergency response must be trained to a level matching the duties they perform, from first responder awareness (recognize a release, protect themselves, notify) through first responder operations (defensive containment from a distance) and higher technician and specialist levels. Awareness level is the minimum for an employee expected only to discover and report.
29 CFR 1910.38Emergency action plansThe employer must have an emergency action plan covering reporting of emergencies, evacuation procedures and route assignments, procedures for employees who remain to operate critical operations, accounting for employees after evacuation, rescue and medical duties, and the names or job titles of employees who can be contacted for further information.
